REMINDER

It has come to the attention of the Philippine Embassy that there were recent cases of Filipino minor children who were prevented from taking their return flights to Italy by the airlines’ check-in counters at Manila airports for their inability to present their own Permits to Stay (Permesso di Soggiorno) separate from that of their parents.

An individual Permit to Stay is now required for all foreigners who are residents in Italy, including infants and minors, under Italian Law of 7 July 2016 N. 122 which took effect on 23 July 2016 and Ministerial Circular Protocol 33530 dated 3 August 2016. With the effectivity of the law, Filipino parents who are holders of Permits to Stay are reminded of the following:

• A Filipino child born in Italy has to have his own Permit to Stay separate from that of his parents. The child’s parents, who should file an application for their child’s Permit to Stay at the Questura (Police Office), are also required to have their own Permits to Stay updated (aggiornamento).

• A Filipino child below 14 whose Permit to Stay is attached (allegato) to that of his parents or legal guardian is required under the law to apply for a separate Permit to Stay upon application by his parents to have their own Permits to Stay updated (aggiornamento).

• A Filipino child who reaches 14 is mandated under the law to immediately apply for a separate Permit to Stay. The child’s parents are, together with the child’s application, required to have their Permits to Stay updated (aggiornamento).

• A Filipino child who reaches 14 but is unable to secure a separate Permit to Stay because he is in the Philippines for vacation is advised to proceed with his parents to the Italian Embassy in Manila to apply for an appropriate visa for the child to be able to re-enter Italy.

To avoid unnecessary delay in your return trip to Italy, all Filipino parents who are holders of Permits to Stay are encouraged to take extra effort to fulfill their obligation under the new Italian law even before their minor children take a vacation to the Philippines. Please be reminded also that all applications for Permit to Stay or visa to enter Italy entail corresponding service fees.
